1. Purpose
These terms set out the rights, duties and responsibilities of Ibranics (“we”) and our business customers in using the Mibnox service.
2. Definitions
- “Service”: Mibnox POS, KIOSK, back office, online payment integration, members and coupons, online stores, integrations (API) and the related software and websites.
- “Customer”: a business that has agreed to these terms and has a service contract with us.
- “Users”: the owners, managers and staff the Customer gives access to.
- “Devices”: the tills, kiosks and other terminals the Customer pairs with the Service.
- “Customer Data”: the products, stock, sales, members and other data the Customer and its Users enter or create in the Service.
3. Publishing and changing these terms
- We publish these terms on our website.
- We may change them within the law. We announce changes on the website and tell Customers by email 7 days before they apply (30 days for changes unfavourable to Customers).
- A Customer that does not accept a change may end its contract. Not objecting before the change applies counts as acceptance.
4. The contract
- The contract starts when the Customer applies and we accept. We may create the account for the Customer at its request.
- The Customer must give accurate details (business name, registration number, representative) and keep them up to date.
- We may refuse or later end a contract made with someone else’s details, false details or for an unlawful purpose.
5. Service scope and fees
- The scope (stores, devices, features), fees and payment terms are agreed in a quote or a separate contract, which prevails over these terms where they differ.
- If fees are unpaid we may limit the Service after notice with a deadline. Customer Data stays protected under section 11.
6. Payments
- Card payments run through the card terminal (VAN) or payment (PG) company the Customer has its own contract with. The money is settled by that company to the Customer; we never receive or hold it.
- Fees and settlement follow the Customer’s contract with that company.
- The Service approves payments only for the order total calculated by the server and tries to cancel any payment it cannot record. Customers should regularly compare their settlement statements with the sales records in the Service.
7. Customer duties
- Keep accounts, passwords and pairing codes safe, give Users only the access they need, and tell us at once about unauthorised use.
- The Customer is responsible for the accuracy of what it enters (business details on receipts, prices, tax categories) and for its own tax and legal duties.
- The Customer is the controller of its members’ personal information and obtains the consents PIPA requires; we process it on the Customer’s instructions.
- Do not use the Service unlawfully, against others’ rights or to disrupt it, and do not reverse-engineer or resell it without a separate agreement.
8. Our duties
- We work to keep the Service reliable and restore it without delay after a fault.
- We protect personal information under our privacy policy and protect Customer Data, including with encrypted backups.
- We handle questions and complaints in good faith.
9. Changes and interruptions
- We may add or change features. We give 30 days’ notice before removing a major feature a Customer uses.
- The Service may pause for maintenance, equipment changes, natural disasters or network failures; planned maintenance is announced. Tills and kiosks are designed to keep selling with cash and integrated terminals without internet.
10. Intellectual property
The rights in the Service and software are ours. The Customer may use the Service within its contract for the contract period.
11. Customer Data
- Customer Data belongs to the Customer. We use it only to provide, support and secure the Service.
- The Customer may ask for an export at any time; we provide it in a common format such as CSV.
- After the contract ends we keep Customer Data for 30 days for export, then destroy it, except what the law requires us to keep, which is stored separately for that period.
12. Ending the contract
- The Customer may end the contract at any time by telling us; remaining fees follow the separate contract.
- We may end it if the Customer seriously breaches these terms and does not fix it within a reasonable period after notice.
13. Limits of liability
- We are not liable for damage caused by natural disasters, the Customer or third parties (telecoms, VAN or PG companies) unless we were at fault.
- To the extent the law allows, we are not liable for indirect or special damage or lost profits, except where caused by our intent or gross negligence.
14. Governing law and courts
Korean law applies. Disputes are first settled by talking; if a lawsuit is needed it goes to the competent court under the Civil Procedure Act.
Addendum
These terms apply from 2026-10-11.
